Terms and Conditions

2. Damage Deposit: a) A $500.00 deposit and signed contract is due at the time of booking to hold the date. b) The Rental Party has 48 hours to cancel the event to receive a full refund of the deposit and any payments made. 3. Cancellation Policy: a) The damage deposit is nonrefundable if the booking is cancelled after 48 hours from booking. b) If the booking is cancelled more than 60 days prior to the event, 50% of the total rental fee is nonrefundable. c) If the booking is cancelled 60 days or less prior to the event, 100% of the total rental fee is nonrefundable. d) If the booking is cancelled and rescheduled to a future date, we will transfer the deposit and rental fees paid to date for a $50.00 processing fee. This only applies to events cancelled 30 days or more prior to the event 4. Rental Fee Payments: See Addendum 5. Alcohol Policy: See Addendum 6. The Rental Party hereby assumes and agrees to be solely responsible for, and as to the Yakima Area Arboretum, jointly, severally, individually, and privately, to hold harmless from all claims and damages of every kind and nature including the cost of defending for damage or injury to person or property and for contract liability arising in any manner from the Rental Party's use and occupancy under this contract. 7. The Yakima Area Arboretum shall not be held liable for any loss or damage sustained by the Rental Party as a result of fire, theft, weather and/or any other conditions beyond the control of the Arboretum. 8. This agreement is personal to the Rental Party and it may not be transferred to any other person or persons. 9. The Yakima Area Arboretum reserves the right to make reasonable rules for the use and occupancy of the site. The Rental Party will accept the facilities in the condition as it exists at the time of occupancy. 10. The Yakima Area Arboretum reserves the right to refuse the use of the Arboretum to any individual or group. The contact person signing this contract accepts any and all responsibility or liability personally and on behalf of the Rental Party for the care and use of the Arboretum, as well as the conduct of the participants and spectators in association with the event. 11. Failure by the Rental Party to comply with the Event Contract and/or Addendum will result in full or partial forfeiture of the damage and/or alcohol deposits. The Yakima Area Arboretum reserves the sole right to set the amount of the forfeiture. 12. Your signature and initials acknowledges your understanding and willingness to adhere to the guidelines outlined in the Yakima Area Arboretum Event Contract and Addendum. 50% of the Rental Fee will be paid within 30 calendar days of the initial booking. Final payment (Paid in Full) must be paid 60 calendar days in advance of the event in order to avoid cancellation of the event by the Yakima Area Arboretum. If any payment outlined in the contract is 10 days past due, the Yakima Area Arboretum reserves the right to cancel the event. Full payment of the Rental Fee is due in full at time of booking. (For events booked less than 60 days in advance). ALCOHOL AND DRUG POLICY An alcohol deposit of $500 must be paid 30 calendar days in advance of the event. This deposit is required for any alcohol brought on to the Yakima Area Arboretum grounds either by the Rental Party, a guest of the Rental Party or both. A Washington State Banquet Permit is required when alcohol is being served at the Yakima Area Arboretum by Rental Party and/or guests. The Banquet Permit must be displayed in a conspicuous place. Washington State law prohibits the smoking of marijuana in public and on public property including the Yakima Area Arboretum. Any use of marijuana by the Rental Party and/or its guest will forfeit the entire alcohol and damage deposits. SECURITY & INSURANCE POLICY For all open invitation events and/or events w/ over 150 guests, the Rental Party will need to hire security & obtain a one-day insurance policy.
