Terms and Conditions
1 CLIENT hereby engages ARTIST and ARTIST hereby agrees to perform the engagement hereinafter provided with all the terms and conditions herein set forth
2 CLIENT agrees to send ARTIST a signed copy of this agreement along with a non-refundable deposit equal to 50% of the total fee, as set out above, within 48 hours of the date indicated at the top of this agreement.
3 Balance is payable by CLIENT to ARTIST at any time prior to services being rendered.
4 If booking is made within 7 days of event date, the full balance will be due upon signing of this agreement.
5 This agreement shall be considered in effect once it has been signed by both parties.
6 CLIENT and VENUE will ensure that ARTIST is performing in a safe working environment.
7 It is understood that this agreement is for a solo piano performance of music. ARTIST will not be obligated to take requests or perform with any additional musicians or vocalists.
8 ARTIST reserves the right of final decision with respect of content, theme, arrangements, style and equipment used for his performance. CLIENT accepts the general nature and scope of ARTIST’s services.
9 Equipment brought to the event by ARTIST is for the sole use of ARTIST.
10 CLIENT and/or VENUE shall be liable for any injury to ARTIST, or damage or disappearance of any equipment while on the premises of the engagement.
11 ARTIST shall be indemnified against any claim for personal injury or damage brought by or on behalf of any third party in connection with the engagement, which claim does not result from the active negligence of ARTIST.
12 It is understood that if CLIENT or VENUE are providing a piano for ARTIST's performance, they shall ensure, at their own expense, that the piano is in a suitable working condition.
13 It is understood that ARTIST is an independent contractor, not an employee of CLIENT or VENUE, and has exclusive control over the means, methods and details of fulfilling his obligations under this agreement.
14 ARTIST shall be entitled to a 10 minute break for each hour of performance
15 Any changes to the performance date, time and location shall be made in writing to ARTIST. It is understood that ARTIST does not guarantee his availability for any rescheduled date and shall not be held liable if he has already been reserved for another engagement on the rescheduled date.
16 Any additional time requested on the date of the engagement shall be charged at a rate of $200/hour.
CANCELLATION POLICY
1 If ARTIST or CLIENT must cancel the engagement due to an emergency, Act of God, "Force Majeure", riot, strike, epidemic, or by the order of any public authority, this contract shall become null and void, all deposit and balance payments shall be refunded, and both parties shall have no further legal recourse against each other.
2 If CLIENT must cancel the engagement for any reason other than that set out in Paragraph 1, above, they shall forfeit the deposit. Furthermore, if CLIENT cancels within 1 week prior to the performance date, ARTIST shall also be entitled to be paid any remaining balance of the guaranteed fee for the performance as set above.
3 If ARTIST must cancel this engagement for any reason other than that set out in Paragraph 1, above,, he shall make every reasonable effort to find a suitable replacement at no additional charge to CLIENT. If a replacement cannot be found, CLIENT shall be entitled to a full refund of any/all money paid to ARTIST.
