CLIENT RESPONSIBILITIES: (1) To provide Company with a completed Event Planner (provided by Company), which includes a playlist of requested songs, no less than two weeks prior to the Event; (2) To ensure that reasonable steps will be taken to protect DJ’s equipment and music while they are located at the Event facility. In the event of circumstances deemed by DJ to represent a real or implied threat of injury or harm to DJ, equipment or recordings, DJ reserves the right to cease performance until such time as Client has the threatening situation resolved; (3) To provide Company with quality copies of any photographs of audio-visual recordings taken at the Event where DJ is visible, within one month following the Event. Client grants Company permission to use photographs or audio-visual recordings in its marketing materials. (4) Client must provide Company with a minimum of four hours notice if canceling Event due to inclement weather. Rescheduling for Events canceled due to inclement weather shall be accommodated subject to Company’s and DJ’s availability.
PERFORMANCE: (1) DJ shall arrive at Event facility approximately one hour prior to scheduled Event start time. (2) in the unlikely event that DJ’s performance is delayed on the date of Event, DJ shall provide Client with performance time equal to time lacking; (3) In the unlikely event that DJ is ill on the date of event and cannot perform the services hereunder, then Company will make every reasonable attempt to provide Client with a substitute DJ with comparable skills, sound system, music, and any other options for which Client has contracted; (4) Should DJ fail to appear at Event for reasons such as (a) any act of God, war, natural disaster or transportation problem over which DJ or Company has no control, (b) closure of Event venue by any local, state, or Federal Government agency, then no further payment from Client is due.
LEGAL: (1) Event facility must meet all Federal, State and Local fire and safety regulations, and hold all appropriate liability insurances, music licenses and performance permits where applicable; (2) Client is responsible for any damages, injuries or delays that occur as a result of failure to comply with provision number (2) of Client Responsibilities; (3) This agreement cannot be cancelled or modified except in writing by either the Client or Company; (4) Any controversy or dispute arises out of or relating to this Agreement shall be rendered by the arbitrator may be entered in any court of competent jurisdiction. The prevailing party shall be entitled to recover from the other party, all of the prevailing party’s costs and reasonable attorneys’ fees incurred; (5) This Agreement and conduct pursuant thereto shall be governed in all respects by the laws of California.
