Terms and Conditions

RESERVATION AND REFUNDS Reservations are tentative and therefore may be canceled by Make Real, Inc. at any time until a signed contract and deposit are received by Make Real, Inc.. The entire balance is due 10 days prior to the event date. Groups are required to arrive at the contracted time. Rooms will only be held 15 minutes past the contracted time. Groups arriving after the 15-minute grace period will be scheduled on an available basis, otherwise space may be forfeited at discretion of the Manager on Duty. In the event the Host cancels, Make Real, Inc. Special Event Contract (the "Agreement") prior to the initial arrival date of the event, Make Real, Inc. will necessarily incur damages including, but not limited to, turning away other group events and the ancillary revenue associated with those events. Notwithstanding any other provisions of this Agreement, the Host shall have the right to cancel this Agreement, without cause, upon written notification (email) to Make Real, Inc. Special Event Team at any time prior to the event. However, a full refund – less costs already incurred by Make Real, Inc. (e.g. catering down payments) – can be processed only if cancellation occurs 2 weeks or more before the scheduled event. After that two-week period, the event is only eligible for a 50% refund. No-Shows will be responsible for the full contracted value of the event. The parties agree that the sums are not a penalty but represent a reasonable effort on behalf of Make Real, Inc. to establish its loss prospectively and represent liquid damages. Such payment shall be made by certified check, credit card or debit card and shall accompany notice from the Host to cancel this agreement. Any attempt to cancel without the inclusion of payment, as set forth above, shall be invalid. CANCELLATION ON BEHALF OF Make Real, Inc. Make Real, Inc. reserves the right to cancel any event at any point at its facility upon a determination, in Make Real, Inc.s sole discretion, that (i) the event violates the Restrictions set forth in the foregoing section, (ii) the Host misrepresented the event in any way (to Make Real, Inc. or any other party) or (iii) the event would be harmful to Make Real, Inc. and/or its guests. In the event of such cancellation, Make Real, Inc. will refund prepaid deposits for the canceled event in question depending on type of cancellation and whether any damages were incurred. If cancellation occurs due to breach in contract Make Real, Inc. is not obligated to refund any of the payments received for said Event. RESTRICTIONS Host understands and agrees that: They shall not assign this Agreement, nor subcontract or resell the rights and benefits provided hereunder, nor act as a promoter for the event, including but not limited to selling tickets, charging admission/cover charges, or seeking donations in lieu thereof; and that the event shall be conducted as described in this Agreement. They shall not bring in any additional outside alcoholic beverages without the prior written agreement with Event Staff, and a Licensed and Insured Bartender to serve alcoholic beverages. They will refrain from intentionally damaging any of our walls, furniture, and assets within our games/building. Decorations must be discussed with Event Staff prior to the event to be approved. They will not bring in catering/food without prior written agreement with our Event Staff, and only have food in our Lounge/Event Space. Food must be handled solely by the Host or third party caterer’s. They will keep noise levels in the venue to a minimum unless purchasing the Full Venue Buyout Option. They will refrain from harassment of staff or other guests in our building. Any harassment is not tolerated. TAX EXEMPT STATUS To be eligible for a Tax-Exempt status, a copy of your company’s Tax Exemption Certificate must accompany your signed contract. Make Real, Inc. can only accept Tax Exempt forms from the state of Florida Groups with the proper paperwork.
