***Reservation and Deposit: Your Private Use reservation is not confirmed until HMS receives the full deposit (or Full Payment) amount as set forth in this Private Use Agreement and HMS receives and accepts the signed Private Use Agreement. If HMS receives another request for private use of the vessel prior to that time, HMS will try to contact Customer for confirmation. If HMS does not obtain Customer’s confirmation, including the deposit and signed and accepted Private Use Agreement within 24 hours of HMS’s attempt to contact Customer, HMS is free to enter into a Private Use Agreement for that vessel with another party. Full payment is due ten days prior to the event date. Payment methods include, check credit card and cash. ***Cancellation: In the event that HMS receives a written cancellation notice from the Customer 60 days or more in advance of the contracted Private Use date, HMS shall refund the full deposit amount. In the event that HMS receives a written cancellation notice from the Customer less than 60 days before the contracted private use date, but more than 7 days before the private use date, HMS shall retain the full deposit amount. If Customer cancels 7 days or less before the private use date, Customer shall be liable for the full amount of the private use fees. HMS, at its sole discretion may find it necessary to cancel the private use due to any of the reasons mentioned in Paragraph 6, in which case, a full or partial (if the private use had commenced) refund may be processed, or a future replacement private use offered in lieu of a refund. ***Payments: The private use price is based on current prices and a maximum of 35 guests, which is the number of guests that the vessel can accommodate. The Customer agrees to pay fees and prices as agreed to at the time of signing of this Private Use Agreement. A final guaranteed guest count applies to all services including beverage and meal service upgrades. If HMS does not receive a final guaranteed guest count 7 days or more prior to the private use, the latest guest estimate as it appears in this Private Use Agreement shall apply as the final guaranteed guest count. Should Customer request any service or catering changes less than 7 days prior to the private use date, Customer agrees to pay the full cost of any such changes as billed to the Customer by HMS. HMS will conduct a gangway count at departure and such count will be final and, if greater than the final guaranteed guest count, will be the basis for additional guest charges. If Customer cancels after date of the final guaranteed guest count, Customer will have to pay the full Private Use fees, including any deposit amount, based on the final guaranteed guest count. The final outstanding balance of the total Private Use price is due eleven days before the private use departure and must be in the form of an approved company check, cashier’s check, certified check, travelers check, cash or major credit card. With respect to entertainment charges, Customer agrees to pay a 50% cancellation fee should Customer choose to cancel any entertainment order less than 15 days prior to the private use date. Customer must pay for additional services requested during the cruise at the end of the private use cruise. Customer must pay any additional costs for guests above 35 people or additional services requested during the cruise at the end of the private use cruise. Any catering costs billed to HMS will be charged within 24-hours after the private use cruise. A major credit card may be requested to guarantee that catering costs are paid.
