Terms and Conditions
Intro:
These terms and conditions govern the relationship between [Hudson’s Group staffing] and the client and any temporary workers or candidates provided by the Agency. By engaging the services of the Agency, the Client agrees to be bound by these terms.The Agency will provide temporary staffing services to the Client as outlined in the request and confirmed in the job order.
Scope of services:
The Agency will recruit, interview, and present candidates for temporary or permanent positions as per the Client’s requirements.
Responsibilities of the staffing:
Recruit and present suitable candidates for temporary or permanent positions based on the Client’s specifications.
Ensure all Temporary Workers are eligible to work legally in the relevant jurisdiction.
Provide candidates with the necessary training, if applicable.
Manage payroll, taxes, and other employer obligations for Temporary Workers.
Responsibilities of the Client:
Provide accurate job descriptions, work conditions, and any special requirements for the position.
Ensure a safe working environment for Temporary Workers.
Notify the Agency immediately if any issues arise with a Temporary Worker, including performance concerns or issues related to work safety.
Pay all invoices as per the agreed-upon terms.
Hiring Fees:
For temporary staff, the Client agrees to pay the Agency’s service fees, as detailed in the Agency’s pricing agreement
If the Client hires a Temporary Worker directly within 6 months of their assignment end date, the Client agrees to pay the Agency a conversion fee based on the terms of the contract.
Payment Terms:
The Client agrees to pay all invoices issued by the Agency within 30 days from the invoice date.
Invoices may include fees for recruitment, placement, and payroll processing for Temporary Workers.
Late payments may be subject to additional charges and interest as specified.
Confidentiality:
Both parties agree to keep all confidential information received from the other party during the course of this agreement confidential, including but not limited to client details, Temporary Worker information, and any proprietary business data.
Liability:
The Agency is not responsible for any damage, loss, or injury to the Client’s business caused by the actions or inactions of Temporary Workers.
The Client is responsible for providing the necessary supervision and oversight of Temporary Workers on the job.
Termination:
Either party may terminate this agreement with 14 days’ written notice.
If either party breaches the terms of this Agreement, the non-breaching party may terminate the agreement immediately.
Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of
Dispute Resolution:
In the event of a dispute, both parties agree to seek resolution through [mediation/arbitration] before taking legal action.
