Terms and Conditions
A. DESCRIPTION OF SERVICES
The Bach Bar, LLC ("Company") will provide mobile bartending services tailored to the event theme, including but not limited to:
Crafting a curated cocktail menu
Beverage service with a focus on enthusiasm and guest engagement
Bar setup and teardown
Glassware and utensil management
Ensuring a clean and hygienic bar area
Note: We specialize in creating a party atmosphere but are NOT an adult entertainment service.
B. RIGHTS AND RESPONSIBILITIES OF THE COMPANY
The Company is responsible for:
Complying with federal, state, and local laws concerning alcoholic beverages
Checking identification for age verification
Refusing service to visibly intoxicated persons or those behaving inappropriately
Maintaining a safe and clean bar area
C. LOCATION AND PERMITS
The client is responsible for:
Securing the event location
Obtaining all necessary permits for serving alcohol, live music, etc.
Providing the Company with confirmed location details a minimum of one week before the event
D. PAYMENT
Payment terms are as follows:
Full payment is due upon booking via an approved digital platform
Non-payment will result in immediate cancellation of services and may result in legal action
E. CANCELLATION POLICY
30 days or more: Full refund
10-29 days: 50% refund
Less than 10 days: No refund
F. LIABILITY WAIVER AND ASSUMPTION OF RISK
By contracting our services, the client assumes all risks associated with alcohol consumption and absolves the Company of any liability related to accidents, injuries, or damages.
G. MODEL RELEASE AND INDEMNIFICATION
The client grants the Company permission to capture and use photographs and videos from the event for promotional and marketing purposes.
H. CONFIDENTIALITY
Both parties agree not to disclose any proprietary or confidential information obtained during the service engagement.
I. INDEMNIFICATION
The client will indemnify and hold harmless the Company against any claims, damages, or legal actions arising from the services provided.
J. WARRANTY
We warrant that all services will be performed with professionalism and in full compliance with all applicable laws and regulations.
K. DEFAULT
A breach of any of the terms of this Agreement will be considered a material default, allowing for termination and legal remedies.
L. REMEDIES
Upon default, the non-defaulting party will provide a written notice and a 7-day period to remedy the default before taking further action.
M. FORCE MAJEURE
Neither party is responsible for failure to fulfill obligations due to uncontrollable circumstances like natural disasters, war, or government restrictions.
N. ENTIRE AGREEMENT
This document constitutes the complete agreement and supersedes all prior oral agreements between the parties.
O. SEVERABILITY
If any provision is found to be invalid, it won’t affect the validity of the remaining provisions.
P. AMENDMENT
Changes or additions to this Agreement must be in writing and signed by both parties.
Q. GOVERNING LAW
This Agreement is governed by the laws of the State of Tennessee.
R. NOTICE
All notices or communications must be sent via certified mail, email, or hand-delivered.
S. WAIVER OF CONTRACTUAL RIGHTS
Failure to enforce any part of this Agreement does not waive the right to enforce it in the future.
