Miss Limousine Service LLC will be referred to as ML for the purposes of this contract. All deposits are NON-refundable. Cancellations within 30 days of the reservation will be liable for 50% of the balance due. Cancellations within 7 days of the reservation will be liable for the full balance due. ML is not liable in the event of mechanical breakdown/problem while on charter and will only be responsible for making up lost time at a mutually agreed date. We reserve the right to supply an alternate vehicle(s) to fulfill a reservation due to mechanical failure. The client assumes full financial liability for any damage to the limousine by them or any members of their party to include loss of revenue if the damage is sufficient to place the vehicle out of service. The client assumes responsibility for the safety of their party with regards to any violations of our terms and conditions, behavior, and/or personal injuries not caused by driver negligence or vehicle accidents. The client/customer waives any and all claims against ML or any agent or employee for injury, loss, or damages including consequences of damages to customer and passengers person or property from any cause or however occurring. Customer hereby acknowledges that no driver or employee of ML has the authority to negotiate pricing, times, itinerary, etc. without approval from the owner. If, for any reason, there is a problem with the reservation, the customer agrees to mediation/arbitration at their expense with a nonbiased attorney firm prior to making any slanderous or libelous statements about ML to any person, social media, review forum, Better Business Bureau, or in any other manner that might negatively impact ML. Failure to do so will result in a $3,000 breach of contract. Customers assume responsibility equally for any similar remarks from any of their passengers.
Fines billable to the customer per occurrence:
• Smoking in vehicle $100 per and every seat/carpet burn
• Sanitation fee is $200.00 for any vomiting or other sicknesses in the vehicle
• Missing/broken glasses $10
• Spills $30
All other damages will be assessed according to the replacement/repair costs, including labor and downtime of the vehicle for any lost revenue by ML.
The driver has the right to terminate any reservation without refund if he/she feels unsafe and/or if there is dangerous behavior, illegal activity or immoral activities that might negatively impact ML to include illegal drugs/substances, underage consumption of alcohol or any other violation of city, county, state, or federal laws.
Overage begins 15 minutes past the time listed on the run sheet and billable in one-hour increments. The customer is responsible for any additional time regardless of cause (i.e. traffic, weather conditions, acts of God). ML is not responsible for belongings left in the limousine. Balances are to be settled no later than the beginning of the reservation. Vehicles cannot be loaded beyond seating capacity. The industry standard of 20% gratuity is required on all reservation up to a $100/hour valuation. For vehicle priced above $100/hour, a minimum gratuity of $20 per hour is required. If no gratuity was given to the chauffeur and not included in the rate quoted, 20% will automatically be applied to the card on file when the ride is closed out in our system. If any discounts were applied such as comped hours, gift certificates, trade, vouchers, etc., the gratuity is/will be calculated based on the pre-discounted rate (full retail value). If the outside temperature is over 85 degrees and the full ride is completed, ML will not issue a refund. If you desire a partial refund for air conditioner failure you must cancel the trip as soon as the issue is noticed.
