Terms and Conditions

1.Deposit: An initial deposit of 25% is due upon execution of this agreement and reserve your date (s) and time (s). The second deposit of 50% is due thirty (30) days prior to your event. The final balance of 25% is due no later than 10 days prior to the Event. If payment is not paid, York365 may terminate this Agreement and retain the Deposit in accordance with Section 2. No access will be given or allowed to commence until payment is resolved. 2. Cancellation and Force Majeure: The initial deposit is nonrefundable unless York365 is forced to cancel in which the full deposit will be refunded. If for any reason beyond its control, but not limited to, fire, strikes, labor disputes, accidents, government requisition, restrictions or regulations on travel, commodities or supplies, acts of war, or acts of God, that York365 is unable to perform its obligation under this Agreement, York365 may terminate this Agreement and will apply all deposits to a mutually agreed upon date in the future, (provided that the Client is not in default under this Agreement). IN NO EVENT SHALL YORK365 BE LIABLE FOR CONSEQUENTIAL DAMAGES. There will be no refund(s) of the space rental fee(s) that will be refunded if canceled within 30 days prior to an event. If the deposits were made, based on sole discretion and availability, York365 reserves the right offer a one-time rescheduling and will apply all deposits to a mutually agreed upon date in the future. If the deposits were not made, York365 reserves the right to cancel your reservation without a deposit refund. 3. Insurance: Special Event Liability Insurance is REQUIRED of all Clients and is due no later than ten (10) days prior to the Event. The insurance must, at Client’s sole expense, provide and maintain public liability and personal property damage insurance, insuring York365, LLC and contractors, contracted vendors against all bodily injury, property damage, personal injury and other loss arising out of clients use and occupancy of the premises including appurtenances to the premises and sidewalks. The insurance required hereunder shall have a single limit liability of no less than $1Million, and general liability of not less than $1 Million. York365, LCC shall be named as an additional insured of said policy. 4. Site Decorations: York365 hopes to make every event here a special and welcoming experiencing. Therefore, every effort will be made to allow the Client to prepare decorations reflecting their creative and vision goals. However, we ask that no nails, screws, staples or penetrating items to be used on our walls, bricks or fine wood. Any type of glue backing material must be carefully and properly removed. Any cause of wall damage will result to the card on file being charged and invoiced. 5. Cleaning, Trash and Equipment Removal: York365 will be in a clean condition prior to the Event. The Client is required to return the space to the same condition in which it was found unless payment for clean-up was agreed upon and made separately ($75 fee). Otherwise, all trash must be collected, properly bagged (trash vs. recycle) and placed in the garbage bins. All Client’s and/or vendor’s equipment must be removed at the end of each Event unless otherwise approved by York365. 6. Lost and Found: York365 takes no responsibility for personal effects and possession left during or after any Event. We do, however, maintain a lost and found and will hold recovered items up to 5 days. Every attempt will be made to return any recovered item to its rightful owner. 7. Promotions and Copyright: It is important to us that you have a fantastic and successful event. York365 should not be linked to any unauthorized promotions beyond this Agreement Event. York365 reserve the right to take pictures of the Event and use them for our marketing and promotional purposes. It is understood by the Client, their guest and vendors that attendance to
