Client Responsibilities: (1) To provide company with a complete list of known duties (provided by the Client) (2) To ensure that reasonable steps are taken into consideration; to protect performance equipment and music while they are located at the event facility. In the event of an implied threat or injury of the performer, equipment or recordings, The performer has the right to cease the performance until the Client has resolved the situation Performance: (1) Performer shall arrive at the Event prior to the scheduled Event start time. (2) In an unlikely event that the performer is delayed on the date of the Event or if (Kizra) is on “tour”, or special event, the event will be cancelled, and all funds will be allocated back to Client (Client) (3) Should the performer not appear at the Event for reasons such as: (a) any natural disaster or transportation problem over which Company has no control, (b) closure of the Event by any Federal Government Agency or any Federal Agency, then no further payment from Client is due. Legal: (1) Event facility must meet all Federal, State and Local fire and safety regulations, and hold the appropriate liability insurance, music licenses and performance permits where applicable; (2) Client is responsible for any damages, injuries, or delays that may occur as a failure to comply with the provision of Client’s Responsibilities. (3) This Agreement cannot be changed or altered except in writing by either the Client or the Company. (4) Any disputes that arise out of relating to the Agreement shall be settled in Houston, Texas according to the rules stated by the American-Arbitration Association, and judgement rendered by the arbitrator may be entered into the court for it’s jurisdiction. The prevailing party will be entitled to recover from the other party, all of the prevailing party’s costs and reasonable attorney’s fee which incurred. (5) This Agreement set forth will be conducted thereof shall be governed to the laws in respect of Houston, Texas. To Confirm This Agreement: (1) Sign One Entertainment Agreement And Return It To Company. Retain a copy for your records. (2) The Deposit of $200.00 Must Be Received By The Due Date (December 13th, 2011 or made beforehand with respect to the Client/Company Agreement ) To Guarantee Services For Contract. (3) Company holds a tentative reservation until that date. (4) Agreements received after the deposit has been due are subject to the performer’s availability; (5) Client signing this Agreement states that he/she is lawfully authorized to enter into the Agreement on behalf of he/she organization (where applicable); (6) This Agreement constitutes the entire Agreement on behalf of both understanding between both Parties with respect to the subject matter. The Parties have executed this Agreement as of the date set forth. This Entertainment Agreement supersedes any and all agreements that are aforementioned within the contract date.
