Cape Ann Cruises LLC (CAC) Charter Terms (updated 03-14-24) 1. Cancellation Policy: Full refund 180+ days before Charter date, 50% refund if 30+ days before Charter date. Cancellation requests must be emailed to info@capenncruises.com. 2. Payments: 50% reservation deposit due within 3 business days from signing, reserves your Charter date, if the date is still available. If the time/date became unavailable, a full refund will be provided if an alternate date is not suitable. If booked within 30 days of Charter, payment due in full. Balance: Charter Balance: Due upon booking or no later than 30 days before the Charter date. Catering Order/Invoice: Due when final order is placed and no later than 14 days prior to Charter. Non-payment may lead to Charter cancellation and forfeiture of payments. Credit Card Payment Authorization: Customer authorizes CAC to run Deposit, Balance, and any remainder payments when due. 3. Change Requests: Changes to the Charter date, guest count, or other arrangements can be requested in writing to info@capenncruises.com. All changes are subject to approval by CAC and may incur additional fees. 4. Weather and Safety: The Captain has authority over the Charter vessel's safety and navigation decisions and reserves the right to delay departure, reschedule, cancel, use another vessel, hold the Charter event while docked, and move the event to an alternate event space as a substitute service. Full refund if no alternative offered. Unsafe conditions caused by guests may lead to Charter cancellation without refund. Examples of unsafe conditions include, but are not limited to, excessive intoxication, aggressive behavior, or failure to follow safety instructions. 5. Passenger List: Full Names and emails required two weeks prior for safety compliance. 6. Photo/Video Waiver: CAC may help capture memories through photos/videos of the Charter guests for sharing and use for promotional purposes without compensation. Participation is implied unless opted out in writing. 7. Additional Fees: Fuel Surcharges: $6/Nautical Mile(NM) applies to trips over 10 NM, unless otherwise waived. 8. Additional Fees: Extra Charter Hours: Billed in hourly increments $500/hour (for charters more than 4 hours). Bar Charges: Paid the day of the Charter before disembarkation with a 20% gratuity/service fee applied to Open Bar Service tabs. Outside Catering-Food Setup/Breakdown Fee: $150 for groups over 15 passengers. Fee waived when CAC provides catering. 9. *Service/Gratuity Fees: A customary 20% fee is applied to all services, including the Charter for clarity in budgeting as yacht charters, are a service-based industry, as are food service and bar. 10. Late Departures/No-Shows: Customer delays may subtract from the scheduled Length of the Charter. No-shows will be treated as customer cancellations and forfeiture of payment. 11. Compliance and Liability: The Customer agrees to comply with all local, state, and federal laws, and follow all safety instructions during the Charter. CAC is not liable for accidents or injuries occurring during the Charter that are not a result of CAC's negligence. If guests are scattering ashes, it must occur outside the 3-mile boundary line. 12. Privacy Policy/email: CAC respects the privacy of its guests. Personal information collected will only be used for Charter organization, necessary communication, and occasional marketing purposes (with opt-out options).
