Terms and Conditions

1.Basic Information. All terms and conditions stated under the heading “BASIC INFORMATION”, above, are fully incorporated herein by reference. 2. Deposit. The Deposit shall be applied to the amount of the full fee for the event (“Fee”), and shall be nonrefundable except as provided in this paragraph. Should Client’s event (“Event”) be canceled or delayed, Client’s deposit (“Deposit”) is forfeited to DDB unless Client provides DDB with sixty (60) days’ prior written notice of the Event cancellation or delay. If Client provides such notice within the prescribed time, the Deposit shall be retained by DDB but may be applied by Client to another event, provided that Client books such an event with DDB at the same time that Client gives notice of the cancellation or delay of the Event. Should the subsequently booked event be canceled or delayed, DDB shall be entitled to keep the Deposit as payment in full. If payment(s) is to be done by check, please make payable to DDB Enterprises. Deposit for this event is 50% unless specified otherwise. All deposits can be made by Cash, Check, or credit card. If by credit card, there will be a 3% convenience fee applied to the final balance. 3. Delay, Interruption, Early Termination. Client is liable to DDB for the full fee (“Fee”) for the Event despite (a) any delay in starting the Services, (b) any interruption in the Services, or (c) any termination of the Services prior to the scheduled End Time, when DDB is not responsible for such delay, interruption, or early termination. 4. Critical Power Requirements. Client is required to provide DDB with not less than one (1) live 15 or 20amp circuit for DDB’s exclusive use at the Event Venue, beginning at the Setup Time and ending at the End Time or earlier termination of the Event. Should the aforementioned one live 15 or 20amp circuit not be made available to DDB as stated above, at any time between the Setup Time and End Time, DDB may elect to proceed with or cancel its Services at its sole discretion. Should DDB elect not to provide the Services in such a situation, Client shall be liable to DDB for the entire Fee and such Fee shall be nonrefundable. 5. Balance of Fee. The balance of the Fee, less the Deposit, must be paid in advance to DDB not less than five (5) calendar days prior to the Event, and shall be nonrefundable after payment for any reason other than DDB’s failure to perform its Services as detailed in this Agreement, provided, however, that such failure of performance on the part of DDB must be due to its own fault and not that of Client or any third party, weather condition, accidental condition, or act of God. 6. Return of Deposit and Fee; Limitation of Liability. Notwithstanding any other provision of this Agreement, Client shall receive a refund of the Deposit and Fee should the Services (the “Refund”) not be performed by DDB, or end prior to the End Time, due to DDB’s sole fault; provided, however, that such Refund shall constitute DDB’s sole liability to Client in any such situation. In no event shall DDB be liable for any special, incidental, or consequential damages for any reason or any act or omission, breach of this Agreement or negligence, including any alleged nonperformance or faulty performance of DDB’s obligations under this Agreement. Client acknowledges and agrees that its sole remedy for any act or omission, breach of this Agreement or negligence by DDB, including any alleged nonperformance or faulty performance of DDB’s obligations under this Agreement shall be the Refund without interest. More Terms will be on every contract.
