Cancellation Policy:
1. Rebook Credit – If the cancellation damages set forth in the Agreement are paid with Group’s notice of cancellation, the Hotel agrees that 100% of the damages paid will be applied as a rebook credit toward the Master Account of a replacement Event booked, actualized and paid for by the Group no later than 6 months. The rebook credit may be applied only to a single group event and is based upon date and rate availability at the Hotel. Any unused rebook credit will be retained by the Hotel. If the replacement Event is cancelled, Group will pay cancellation damages pursuant to this agreement for the replacement event and the rebook credit provided in this paragraph will be retained by the Hotel. No rebook credit is available if Group cancels the Event less than 14 days in advance of the Event.
2. Cancellation – Room Nights and F & B- “Group Cancellation” means the complete termination of the contracted event, not elimination of portion of the program, [[and, to the extent applicable]/[or], a cancellation of all individual room cancellations]. If Client requests a Group Cancellation, the cancellation policy overrides the attrition allowance of this contract. The following describes the cancellation policy’s computation of the liquidated damages to be applied in the event of a cancellation:
Should a Group Cancellation become necessary, the hotel must receive a cancellation notification in writing and a cancellation fee may result. This fee is based upon the anticipated guest room and meeting room revenue. All liquidated damages are due and payable upon receipt of invoice.
• In the event of a group cancellation occurring within two weeks of arrival prior to arrival, liquidated damages in the amount of one hundred percent (100%) of the Room Night Commitment, seventy percent (70%) of the Minimum Banquet Food and Beverage Revenue, and Total Meeting Room Rental will be due, plus applicable taxes.
• In the event of a group cancellation occurring less than 30 days in advance prior to arrival, liquidated damages in the amount of seventy-five percent (75%) of the Room Night Commitment, forty percent (40%) of the Minimum Banquet Food and Beverage Revenue, and Total Meeting Room Rental will be due, plus applicable taxes.
• In the event of a group cancellation occurring 31 to 180 days prior to arrival, liquidated damages in the amount of fifty percent (50%) of the Room Night Commitment, seventy percent (40%) of the Minimum Banquet Food and Beverage Revenue, and Total Meeting Room Rental will be due, plus applicable taxes.
• In the event of a group cancellation occurring 181 to 365 days prior to arrival, liquidated damages in the amount of twenty five (25%) of the Room Night Commitment, forty percent (40%) of the Minimum Banquet Food and Beverage Revenue, and Total Meeting Room Rental will be due, plus applicable taxes.
• In the event of a group cancellation occurring between the time of acceptance of this contract and 366 days prior to arrival, liquidated damages in the amount of twenty percent (20%) of the Room Night Commitment, forty percent (40%) of the Minimum Banquet Food and Beverage Revenue, and Total Meeting Room Rental will be due, plus applicable taxes.
